1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "Client") and Kishan Yadav Digital ("we," "us," or "our"), concerning your access to and use of the kishanyadav.shop website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site") and our services.

By accessing the Site and using our services, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Site and services and you must discontinue use immediately.

2. Services Provided

Kishan Yadav Digital provides digital marketing and web development services, including but not limited to:

  • Search Engine Optimization (SEO)
  • Pay-Per-Click (PPC) Advertising
  • Website Design and Development
  • Content Marketing and Copywriting
  • Analytics and Reporting

The specific deliverables, timelines, and scope of work for each project will be detailed in a separate proposal, statement of work, or invoice provided to the Client.

3. Client Responsibilities

To ensure the success of the project, the Client agrees to:

  • Provide all necessary access to website backends, analytics accounts, and hosting environments required to perform the services.
  • Deliver requested content, images, logos, and feedback in a timely manner.
  • Designate a single point of contact with full authority to provide necessary information and approvals.
  • Ensure that all materials provided to us do not infringe on any third-party intellectual property rights.

We are not responsible for delays caused by the Client's failure to provide necessary assets or approvals on time.

4. Fees and Payments

Invoicing: Services are billed as described in the project proposal. Invoices are sent electronically and are due upon receipt unless otherwise specified.

Late Payments: Failure to pay invoices by the due date may result in a suspension of services. We reserve the right to charge a late fee on overdue balances.

Refunds: Due to the nature of digital services and labor involved, all payments are generally non-refundable once work has commenced, unless otherwise stated in a specific agreement.

5. Intellectual Property Rights

Client Ownership: Upon full payment of all fees, the Client will own the copyright to the final creative deliverables (e.g., website code, custom graphics, written content) created specifically for them.

Our Rights: We retain the right to use the completed project and any preliminary designs for the purpose of design competitions, future publications on design, educational purposes, and the marketing of our business (e.g., in our portfolio).

Tools & Methodologies: We retain all rights to our proprietary tools, code libraries, and methodologies used to create the deliverables.

6. Confidentiality

Both parties agree to keep confidential any proprietary information received from the other party that is marked as confidential or reasonably understood to be confidential. This includes business strategies, customer lists, and technical data. This obligation survives the termination of this agreement.

7. Limitation of Liability

In no event will we be liable to you or any third party for any lost profit or any indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the site or our services, even if we have been advised of the possibility of such damages.

We do not guarantee specific results (e.g., specific search engine rankings or sales figures) as these are influenced by third-party algorithms and market conditions outside our control.

8. Termination

Either party may terminate the service agreement with written notice as specified in the project proposal (typically 30 days). Upon termination, the Client shall pay for all services rendered and expenses incurred up to the date of termination.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. You are advised to review this page periodically for any changes.
